1. Who We Are

CarLink is operated by CarLink HQ LLC ("CarLink HQ," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the CarLink mobile application, website, and any related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Community Guidelines. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to create a CarLink account. If you are under 18 (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed these Terms and agrees to them on your behalf.

At signup, you are required to provide your date of birth so we can verify you meet this minimum age. CarLink enforces this requirement in the app and on our servers; accounts that misrepresent age may be suspended or terminated. See our Privacy Policy for how we store and protect that information.

You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Your Account

When you sign up, you give CarLink HQ a non-exclusive, royalty-free, worldwide license to host, store, and display the content you upload — profile photos, banner photos, garage photos, posts, comments, stories, direct messages, show flyers, and event metadata — solely for the purpose of operating the Service.

You can:

  • Edit or delete your content at any time from within the app.
  • Make your account private so that only approved followers can

see your posts, garage, and follower list.

  • Delete your account, which removes your profile, posts, garage cars,

stories, and messages from public view. Some content may persist in backups for a limited period as required for legal, security, or operational reasons.

4. What You Post

You retain ownership of the content you upload. You grant CarLink HQ a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, host, store, reproduce, modify (for formatting, re-encoding, and resizing), publish, publicly perform, publicly display, and distribute that content within the Service. You also grant other CarLink users the right to view and interact with your content according to your privacy settings.

You represent that:

  • You own or have all necessary rights to the content you upload,

including the rights to any photographs of vehicles or events that show third parties.

  • Your content does not infringe anyone else's intellectual property

rights, privacy rights, or publicity rights.

  • Your content complies with our Community Guidelines.

You may not upload content that is illegal, defamatory, obscene, threatening, harassing, fraudulent, deceptive, or that violates any law in your jurisdiction or ours.

5. Acceptable Use

You agree not to:

  • Use the Service in any way that violates applicable law, our

Community Guidelines, or these Terms.

  • Impersonate another person, business, or entity, or misrepresent

your affiliation with one.

  • Scrape, copy, or systematically extract data from the Service

without our express written permission.

  • Reverse-engineer, decompile, or attempt to extract the source code

of the Service except to the limited extent permitted by law.

  • Use the Service to send unsolicited commercial messages, spam, or

bulk promotional content.

  • Interfere with, disrupt, or place an unreasonable load on the

Service or its infrastructure.

  • Use automated systems (bots, scripts, scrapers) to access the

Service except as expressly permitted.

  • Sell, resell, or rent your account.

6. Shows and Events

CarLink lets users create and manage car-show listings, including public events and private (invite-only) events. CarLink HQ does not process ticket sales, admissions, payments, or refunds. If an event charges admission, all transactions happen off-platform between the organizer and the attendees. If you are an event organizer:

  • You are solely responsible for the accuracy of the information you

publish (date, time, location, admission terms if any, age restrictions, attendance caps, parking, etc.).

  • You are solely responsible for compliance with applicable laws,

including event permits, insurance, alcohol licensing, vehicle and pedestrian safety, and accessibility.

  • You are solely responsible for any contracts you form with

attendees, sponsors, vendors, venues, and third parties.

  • CarLink HQ is not a party to any agreement between organizers

and attendees and does not act as an agent, broker, payment processor, or representative of any organizer.

If you attend an event, you understand that CarLink HQ is not the organizer, host, or insurer, and you assume the inherent risks of attending a vehicle event.

7. Messages, Stories, and Direct Communication

Direct messages are visible only to the participants in the conversation (and CarLink HQ to the limited extent necessary for moderation, abuse review, and legal compliance). Stories are visible for 24 hours from the time of posting and then expire from public view.

You should not assume that any communication on the Service is end-to-end encrypted unless we expressly state so in our Privacy Policy.

8. Followers, Following, and Private Accounts

If your account is public, anyone can follow you and see your content subject to the privacy settings on individual surfaces (Garage Visibility, DM permission, etc.).

If your account is private, follow requests must be approved by you before the requester can see your posts, garage, or full follower list. You may revoke a follower's access at any time by removing them from your followers list or by blocking them.

Blocking a user prevents them from seeing your content, finding your profile in search, sending you messages, or interacting with your posts. Blocked users are not notified of the block.

9. Verification

CarLink HQ may, at its sole discretion, mark certain accounts as verified with a blue checkmark. Verification indicates that we have confirmed the account belongs to the person, brand, organization, or entity it claims to represent. Verification does not constitute an endorsement of the user's content or business.

10. Intellectual Property

The CarLink name, logo, app icon, branding, design, software, and underlying technology are owned by CarLink HQ LLC and are protected by intellectual-property laws. Nothing in these Terms grants you any right to use the CarLink trademarks except to identify CarLink as the source of the Service.

You may not use any CarLink trademark, logo, or branding without our prior written consent.

11. DMCA / Copyright

CarLink HQ respects intellectual-property rights. If you believe content on the Service infringes your copyright, send a notice to [email protected] with:

  • A description of the copyrighted work you claim has been infringed.
  • The exact URL or location within the Service of the allegedly

infringing material.

  • Your contact information (name, email, phone, address).
  • A statement, made in good faith, that the use is not authorized by

you, your agent, or the law.

  • A statement, under penalty of perjury, that the information in your

notice is accurate and that you are the owner or authorized to act on the owner's behalf.

  • Your physical or electronic signature.

We will respond consistent with the requirements of the Digital Millennium Copyright Act, which may include removing the content and notifying the user who posted it. Repeat infringers' accounts may be terminated.

12. Termination

You may delete your account at any time. We may suspend or terminate your account, with or without notice, if we reasonably believe you have:

  • Violated these Terms or our Community Guidelines.
  • Created risk or possible legal exposure for CarLink HQ.
  • Used the Service to deceive, defraud, or harass other users.
  • Engaged in repeated infringement of intellectual-property rights.

Upon termination your right to use the Service ends. The provisions of these Terms that by their nature should survive termination — including ownership, indemnification, disclaimers, and dispute resolution — will survive.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR ACCURACY. CARLINK HQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

CarLink HQ is not responsible for the conduct of users on or off the Service. We do not endorse any user, content, opinion, vehicle, modification, build, event, organizer, or third party referenced in the Service.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARLINK HQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OR INABILITY TO USE THE SERVICE; (b) ANY CONTENT OBTAINED FROM THE SERVICE; (c) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; OR (d) ANY THIRD PARTY'S CONDUCT OR CONTENT.

OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID CARLINK HQ IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless CarLink HQ LLC and its officers, directors, employees, and agents from any claim, demand, loss, liability, damages, judgment, settlement, fine, cost, or expense (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. The federal and state courts located in Cherokee County, Georgia will have exclusive jurisdiction over any dispute that is not subject to arbitration.

Informal resolution. Before filing any claim, you agree to contact us at [email protected] and to attempt in good faith to resolve the dispute informally for at least 30 days.

Binding arbitration. Except for claims for injunctive relief and small-claims-court claims, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, in Atlanta, Georgia. You and CarLink HQ each waive the right to a trial by jury and the right to participate in a class action.

17. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email or through the Service at least 30 days before the change takes effect. Your continued use of the Service after the effective date of the change constitutes acceptance of the updated Terms. The current version is always available at legal/terms_of_service.md and inside the app under Settings → Legal.
